Q: My HOA has put up cameras at the pool, in the clubhouse and in the office. Our office employee is a renter and can monitor all of the cameras. At the last board meeting, the HOA president stated that the cameras will have audio and video and a camera going in and out with have a license plate reader. Another board member said that he will be the only one with access to view the cameras, but clearly the office manager also can view. I believe he also has viewing capabilities on his personal phone. They still have no signs up stating cameras are on property. Can this be done?

A: Yes, it can be done. The association does need to install signs at the community to advise the residents and guests.

Q: Our HOA Board meets a mere four times each year, relying solely on Zoom meetings, much to the chagrin of our homeowners.

Open meetings are recorded on an electronic device once a quorum is established and the meeting starts officially.

What troubles our membership is that those electronic decisions, deferrals, discussions are never transcribed into written form for ease of access by members.

Those transcribed written notes would be a very useful tool for a homeowner to be properly prepared for subsequent meetings, when that subsequent agenda is circulated in advance of meeting.

Please provide guidance to us if written transcribed meeting notes (in some concise form, not lengthy) are a requirement for formally convened open HOA meetings — beyond those recognized confidential matters.

A: Per NRS 116.31083 (5) the notice of a board meeting must include notification of the right of the homeowner to have a copy of the audio recording, the minutes or a summary of the minutes in electronic format at no charge. If the association is unable to electronically provide the copy of summary of the minutes, the association must send in paper format. The association can only charge .25 per page for the first 10 pages and .10 per page thereafter.

Section 8 of this law requires the association to audio record the board minutes (not the executive minutes). The audio recording of the minutes must be provided to any homeowner upon request.

Zoom meetings can be saved and zoom is capable of producing a summary of the minutes. Technically, homeowners could be sent a copy of the video meeting and the summary.

The reader’s homeowners can request copies of the audio recording of the meeting.
