Attorney: Woman arrested in Metro officer’s shooting is innocent

An attorney representing a woman accused in the shooting of an off-duty Metropolitan Police Department corrections officer disputed accusations against his client on Tuesday.

The shooting of an off-duty Metropolitan Police Department corrections officer unfolded as the officer was engaged in a contentious child custody dispute with his ex-girlfriend, according to an arrest report.

On Monday, the Metropolitan Police Department arrested Guadalupe Ramirez, 49, and her brother, Agustin Victor Ramirez, 51, in the Sept. 21 shooting of officer Blane Dereis in Las Vegas. Police said in an arrest report that Guadalupe Ramirez is the ex-girlfriend of Dereis, and that the two were in a child custody battle involving their 3-year-old daughter.

The Ramirez siblings are in custody on suspicion of of attempted murder, conspiracy and other felonies. Guadalupe Ramirez is housed at the Clark County Detention Center, while her brother is in custody in California awaiting extradition.

An attorney for Guadalupe Ramirez, Philip Singer, said Tuesday morning his client had nothing to do with the shooting.

“She is 100 percent innocent,” Singer said.

Police said in the arrest report that Dereis was walking out of a business with his girlfriend, Tanya Binko, and her 13-year-old son in the 7600 block of West Cheyenne Avenue at 8:43 p.m. when a man on a black electric bike rode past Dereis, then shot him. The officer was taken to a local hospital with a gunshot wound to the abdomen. He underwent surgery and his condition was stabilized.

As police investigated the shooting, they learned of the child custody dispute and of allegations that Guadalupe Ramirez was harassing Dereis’ girlfriend. Guadalupe Ramirez had obtained a restraining order against Dereis, which was dissolved. Dereis’ girlfriend then pursued a restraining order against Guadalupe Ramirez.

“She said Guadalupe used several ‘fake’ social media accounts over the last year to contact her and make threats towards her,” police said.

The custody dispute was so contentious that child exchanges were carried out between Dereis and Guadalupe Ramirez at a North Las Vegas police substation.

Police said they also interveiwed Dereis.

“Blane said he never though Guadalupe would be capable of having him shot,” police said. “However, during their relationship he did not know she was a convicted felon and between learning she was and the ongoing hostility of the custody dispute he believed it was possible she had someone shoot him.”

Guadalupe Ramirez was previously convicted of money laundering in California and was sentenced to prison for six years, police said. Augustin Ramirez is also a convicted felon with prior arrests for being a participant in a criminal street gang, burglary and robbery. He was also arrested in North Las Vegas in May on suspicion of prohibited person possessing a firearm.

The gunman, police said, arrived in the parking lot on Cheyenne about 30 minutes prior to the shooting and appeared to be targeting Dereis. Police said when they contacted Guadalupe Ramirez about the shooting “she expressed surprise, however, her tone did not seem to reflect her surprise or appear genuine.”

Police said video surveillance from near Guadalupe Ramirez’s home showed Agustin Ramirez wearing clothes similar to the gunman’s in the hours before the shooting. Automated license plate readers also placed Agustin Ramirez in a vehicle that was spotted near the shooting scene.

A witness told police Agustin had an electric bicycle and a helmet similar to the one worn by the gunman.

“During the course of the investigation it was learned Guadalupe was the only individual who would gain from Blane being shot due to their ongoing, tumultuous custody dispute,” police said.

Guadalupe Ramirez appeared in Las Vegas Justice Court Tuesday morning. Singer said

Guadalupe Ramirez had nothing to do with the shooting and that Agustin Ramirez acted on his own.

“She cooperated. She will always cooperate,” Singer said. “She’s cooperated from day one, and she will continue to cooperate. When the proof comes out it is going to show she didn’t do anything.”

Singer described Agustin Ramirez as a gang member.

“He is the gunman,” Singer said. “She told everybody that. … She told Metro, ‘he is an OG gang banger.’”

Court records do not list an attorney for Agustin Ramirez.

Singer said his client was handling the child custody proceedings involving the child the right way by retaining an attorney.
